Photo Stanislav Dzhaarbekovstanislav Dzhaarbekov-member of the Moscow  audit chamber, Moscow Business School coach, lawyer. Tax consultant with 25 years of experience. Our advice will be useful for individual entrepreneurs, General and financial Directors of companies, as well as anyone who wants to start a business in a crisis, but does not dare.

Preparatory stage
PREPARATORY STAGE
Make sure that the company’s documents are in order. There are 4 situations when tax benefits are denied, even if everything is legally and documented correctly:

Fictitious transaction
Accounting for transactions based on their legal form,  not real economic content
No business purpose (transaction exclusively  for the benefit)
Deal with a one-day company Choosing a profitable scheme CHOOSING A PROFITABLE SCHEME It is impossible to completely refuse to pay taxes and not incur the wrath of the tax service. But you can switch to a preferential tax system and replace several payments with one. This way you will save money, make your accountant’s life easier, and make it easier to communicate with the tax authorities.

SIMPLIFIED TAXATION SYSTEM (USN)
This is suitable if your company does not have branches, annual revenue does not exceed 68,820,000 rubles, and the number of employees is less than 100. When the USN reports to the IFNS is submitted only once a year. Let’s figure out which taxes go away and which ones remain to be paid.

NOT PAY

Wealth tax
Unified social tax
PAY
Insurance premiums to the FIU and FSS
Taxes on advertising, transport,
land, etc.
Personal income tax (for sole proprietors)
VAT (excluding imports)
An important point when switching to the USN is the choice of the tax rate of 6% or 15%. To determine the best rate for your company, use the “sixty percent rule”:

Expenses less than 60% of USN revenue under 6%
Expenses more than 60% of USN revenue under 15%
POSSIBLE RISK
The ban on opening branches of the Business is not growing
You don’t need to create invoices, contractors Leave,
who pay VAT
UNIFIED TAX ON IMPUTED INCOME (UTII)
The benefit is only valid for regional businessmen, since this tax has been abolished in Moscow and partially in Saint Petersburg. Implement this mode if your team employs less than 100 people, and the field of activity is included in the list established by law. Now let’s get acquainted with the main industries that can safely claim to use the unified tax system:

THE PATENT SYSTEM OF TAXATION (PSN)
It is designed only for individual entrepreneurs with an annual income of up to 60 million rubles and a staff of no more than 15 people. The areas are almost the same as for the UTI. You buy a special tax patent for a period of 1 month to a year. The tax rate is 6% of the amount of potential income that the state determines for your industry.

VAT (excluding imports)
Personal income tax
PAY
Insurance premiums to the FIU and FSS
Taxes on advertising, transport, land, etc.
POSSIBLE RISK

and region
SOME TAX REGIMES CAN BE COMBINED, FOR EXAMPLE, USN AND UTI, PSN AND USN, UTI AND PSN (FOR INDIVIDUAL ENTREPRENEURS).

Who else can expect benefits?
WHO ELSE CAN EXPECT BENEFITS?
Participants of the SKOLKOVO project for 10 years
they are exempt from VAT.
0% VAT rate is provided
for exporting companies.
Software developers can
count on reduced rates for social taxes (pension and insurance premiums).
For territories of advanced development, there are
relief on insurance payments and income tax.
Companies are exempt from VAT for 10 years
and property taxes.
How does it work?
HOW DOES IT WORK?
Let’s look at an example from expert practice. Stanislav Djaarbekov developed a plan of events for large companies selling consumer goods.

AS A RESULT:
The amount of taxes decreased by RUB 15 million per year
The tax burden has decreased from 13% to 10.5%
DURING THE AUDIT OF THE EXISTING SYSTEM WEAKNESSES WERE IDENTIFIED:
The company used fixed assets that relate to high energy efficiency facilities. However, the property tax benefits and the 2-step depreciation factor applicable to such properties were not applied.
Subsidiaries in different cities of Russia did not enjoy regional benefits for property and income taxes.
Management expenses of the parent company were not fully distributed among the subsidiaries due to unbalanced financial flows. As a result, the tax burden on subsidiaries did not decrease, and the business suffered losses.
The company activated the above-mentioned benefits and changed the mechanism for covering expenses of the head office, and thus optimized tax costs.

Before you start optimizing, we recommend that you analyze the current situation, assess the risks, and check what benefits are available to you.

Although reducing the tax burden is not a panacea, it is a great option for today’s market situation. Apply our recommendations in your company and keep track of changes in legislation.
